The Big Stone City council met in regular session on Monday, November 7, 2022.  Mayor Athey called the meeting to order at 5:30 p.m.  Roll call Roscoe, Brown, Stoddard, Rabe, Zahnow and Redfield.  Others present: Kelsey Stock, Nancy Lee, Redgey Rademacher, Bryan Austin, Pat Kaiser, Robert Athey, Julie Enstad, Theresa Goergen, Dewane Stoddard, Gene Biever, Kathy Rabe, James McFarlane, Karen McFarlane, John McFarlane, Wesley Bowsher GCSO, Christina Athey, Margaret Kuefler, and Chris Brozik with Civil Design Inc.
The Pledge of Allegiance and the State Dakota State Pledge were recited.
Motion to accept the Minutes from October 3, 2022 regular meeting was made by Rabe and seconded by Zahnow.  All in favor. Motion carried.

Motion to accept the claims was made by Redfield and seconded by Brown.  All in favor.  Motion Carried.
Redgey Rademacher, Utilities Manager discussed the inspection that was done on Lift Station #2.  Four valves are needing to be replaced.  If the Lift station were to get plugged up the valves would not be able to stop it. It will take roughly 10 – 12 hours for the repair and it will not interfere with any City resident’s services.  He has received a quote on the repairs and is looking into our options.
Sheriff’s Office report was read with 102 hours reported working in the City of Big Stone City. Calls for service are as follows traffic complaint, security check, vehicle accident, a welfare check and one suspicious person check. 
Robert Athey presented the Council with his proposal for being backup/on call for the City of Big Stone City.  With having been in this position for 45 years, there will be times that Redgey will need assistance. Robert also wanted to thank the City Council for the retirement party.
Redfield made a motion to pay $50 per hour with a two hour call out time for Robert Athey and the City will continue to pay his phone until July 1, 2023. At that time, it will be re-evaluated.  Rabe seconded the motion.  Upon roll call the Ayes: Brown, Rabe, Stoddard, Zahnow, Redfield, Roscoe. Nayes: None.  Motion carried.
Chris Brozik, Representative with Civil Design, Inc. discussed with the Council the Bridge Inspection that was conducted. With the age of the bridge being over 20 years old it is required by the State for inspections every year. SDDOT is going out for bids in 2023 for the 2024 Plan on Bridge Replacement.  The inspection report can be read at the City of Big Stone City office.
James McFarlane presented to Council a map of the location for the Cannabis Dispensary and noted that the States requirements are that businesses can not be within 1000 feet of a school.  In looking at the map if you go by (the way a crow flies) the business is 940 feet.  Therefore, Mr. McFarland was asking for a variance for the property.  After a lengthy discussion with Council and the City Attorney. Stoddard made a motion to approve the variance providing it has legal approval from the City Attorney. Rabe seconded the motion and upon roll call the Ayes: Redfield, Roscoe, Zahnow, Brown, Stoddard. Nyes: Rabe.  Motion Carried.
Redfield made a motion to table until next council meeting the approval of the Cannabis Dispensary License for MacDaddy’s.  Rabe seconded the motion and upon roll call the Ayes: Brown, Roscoe, Stoddard, Rabe, Zahnow and Redfield. Nayes: None. Motion Carried.
Stoddard made a motion to extend the farmland rental agreement with Chris Rabe for the 2023 and 2024 year as agreed upon in the previous terms. Rabe seconded the motion.  All in favor.  Motion Carried.
The current cleaning person for the Community Center has put their two weeks notice in and the last day of cleaning is November 8, 2022.  Discussion was held regarding hours and pay moving forward.
Stoddard made a motion to approve the hiring of a cleaning person at $16.00 per hour. Rabe seconded and upon roll call the Ayes: Zahnow, Redfield, Rabe, Roscoe, Brown, and Stoddard. Nayes: None.  Motion Carried.
Roscoe made a motion for the hiring of Robin Tietgen for the cleaning position and Stoddard seconded upon roll call the Ayes: Redfield, Rabe, Stoddard, Brown, Zahnow and Roscoe. Nayes: None. Motion Carried.
Stoddard made a motion to approve the Uniform Alcoholic Beverage License for The Grocery Basket and Brown seconded. All in favor.  Motion Carried.
Nancy Lee, Finance Officer informed the council of the updated POET Biorefining charges from late 2021 thru September 2022.  In recalculating each months charges they would have a total credit of $64,169.90 applied to there account. 
Stoddard made a motion to apply the full credit towards POET Biorefining’s account and Zahnow seconded the motion. Upon roll call the Ayes: Rabe, Brown, Roscoe, Stoddard, Zahnow and Redfield. Nayes: None.  Motion Carried. 
Discussion was held on the 2020 Local Federal Replacement Agreement.  City Attorney Kelsey Stock is looking into this matter for better clarification before it is signed.
The next Council meeting will be on Monday, December 5th, 2022 at 5:30 p.m. 
Being no further business a motion to adjourn the meeting at 6:27 p.m. was made by Stoddard and seconded by Redfield.  All in favor.  Motion carried.
