Call to Order –  The City Council met in special session at 6:00 p.m. in the Visitor Center, 1001 E 4th Ave. Mayor Raffety presiding.  

Roll Call – Mayor Raffety. Councilmembers: Roger Briggs, Mike Hanson, Josh Karels, Mindy Rogers, Craig Weinberg.  Absent: John Weyh.

Staff Present: John Forman, Cynthia Schumacher.

Public Present: Holli Seehafer, Kathy Ward.

Resolution 3-20-23 – A motion was made and seconded to approve Resolution 3-20-23, Funding Resolution.  Motion carried 5-0.

RESOLUTION  3-20-23

RESOLUTION AUTHORIZING AN APPLICATION FOR FINANCIAL ASSISTANCE, AUTHORIZING THE EXECUTION AND SUBMITTAL OF THE APPLICATION, AND DESIGNATING AN AUTHORIZED REPRESENTATIVE TO CERTIFY AND SIGN PAYMENT REQUESTS.

WHEREAS, the City of Milbank (the “City”) has determined it is necessary to proceed with improvements to its Drinking Water System, including but not limited to well upgrades, chemical equipment, high service pumps, etc. (the “Project”); and 

WHEREAS, the City has determined that financial assistance will be necessary to undertake the Project and an application for financial assistance to the South Dakota Board of Water and Natural Resources (the “Board”) will be prepared; and

WHEREAS it is necessary to designate an authorized representative to execute and submit the Application on behalf of the City and to certify and sign payment requests in the event financial assistance is awarded for the Project,

NOW THEREFORE BE IT RESOLVED by the City as follows:

1.  The City hereby approves the submission of an Application for financial assistance in an amount not to exceed $12,500,000 to the South Dakota Board of Water and Natural Resources for the Project.

2.  The Mayor is hereby authorized to execute the Application and submit it to the South Dakota Board of Water and Natural Resources, and to execute and deliver such other documents and perform all acts necessary to effectuate the Application for financial assistance.

3.  The Mayor is hereby designated as the authorized representative of the City to do all things on its behalf to certify and sign payment requests in the event financial assistance is awarded for the Project.

Water Improvements & Rates – Two rate options and scenarios were presented and reviewed. One option showed the bond repayment using 100% base rate.  In option two, repayment was split using both base rate and usage fees, 60%/40% respectively.  Finance officer Schumacher was requested to present two additional repayment scenarios. Option one, splitting repayment 50% each from the base rate and the usage rate.  The second option would use a 40%/60% repayment between the base rate and usage rate, respectively.  The council will review all options at the April meeting.  Mayor Raffety stated he would like to finalize the rate structure at the May meeting.   

Adjourn –Next Regular meeting meet is April 10, 2023, at 7:00 p.m.  A motion was made and seconded to adjourn at 6:40 p.m. Motion carried 5-0.
