PURSUANT TO DUE CALL AND NOTICE THEREOF, a regular meeting of the City Council was duly held at City Hall at 7:00 PM. The following members were present: Mayor Pat Raffety, Councilmen Joel Foster, Mike Hanson, Scott Hoeke, James Johnson, Josh Karels and Steve Wiener. Absent: None. Present from the staff: Attorney Mark Reedstrom, John Forman, Boyd VanVooren, Cynthia Schumacher, Scott Meyer, Dick Poppen, Darin Thiele and Ron Krause. Public present: Melanie Reiners, Roger Reiners, Holli Seehafer and Brent Hanson.
Mayor Raffety called the meeting to order, and the roll call was taken.
Melanie and Roger Reiners addressed the council regarding extensive damage to their house and cost incurred resulting from the city relocating a nearby storm water catch basin to accommodate the neighbor’s construction plans. Reiners asked if there was any assistance the city could offer to recoup the incurred expense. Reiners have installed an additional catch basin on their property, adding to the expense. Attorney Reedstrom stated such drainage issues are between homeowners and should be resolved in civil court.
A motion was made and seconded to approve the minutes from the July 10 and August 10, 2020 meetings. Motion carried 6-0.
A motion was made and seconded to approve the Consent Agenda. Motion carried 6-0.

DEPARTMENT REPORTS
Water – Councilman Wiener read the monthly report; Work was done on the underground storage pumps, well #1 air conditioner and several curb stops. The water meters were read for the quarter. There were five on the monthly shut off list. The city is utilizing 62% spring water.
A public hearing was held for the consideration to lease hay ground described as the SE ¼ NE ¼ Section 16, Township 120 North, Range 50 West of the 5th P.M., containing approximately 33 acres. No objections were heard. A motion was made and seconded to call for bids for the lease of said hay land. Motion carried 6-0.
Grant County Economic Development – No report.
Street – New traffic signage was installed, and crosswalks painted in the school areas. The salt sand is being prepped for winter. Working with Up North Concrete on various street repairs. Mosquito spraying continues as weather permits.
No snow removal bids were received.
Rubble Site – The site has been busy, debris from four houses and two commercial buildings were hauled in. The site was burned August 31, 2020.
Baseball Complex – Councilman Hoeke reviewed a segmented building plan. The Ball Diamond Association is hoping for a groundbreaking in October.
Park – Councilman Karels reported the sprinkler system at Pribyl park was repaired, picnic tables painted, soccer and football fields painted, and the cemetery seeded. They installed a new fountain at the Visitor Center.
City Administrator Forman stated, 70 applications have been received for the Park & Recreation Director position. The closing date is September 18, 2020.
A motion was made and seconded to approve Resolution 9-14-20A. Councilman Foster introduced the resolution stating he was approached by Boyd Sussex with the request to honor Lane Lindquist for endless hours of volunteering, and years of teaching and serving on the city council. Councilman Wiener voiced his reservation about the resolution. Motion carried 4-2.

Resolution to Rename
Public Roadways
WHEREAS, the City Council of the City of Milbank has the authority to rename streets, avenues, and public passageways within the City of Milbank; and
WHEREAS, Lane Lindquist spent 28 years teaching in the Milbank School District and spent 17 years on the Milbank City Council, and tirelessly devoted time and energy to both institutions; and
WHEREAS, the road running on the south side of the Milbank Cemetery from the Unity Square parking lot to Flynn Drive and serves as a recreational route for bikers, runners and walkers in Milbank and borders both city property and school property.
THEREFORE, BE IT RESOLVED, that the City Council of the City of Milbank does hereby order that the aforementioned public right-of-way running from the Unity Square parking lot to Flynn Drive within the City of Milbank, County of Grant, State of South Dakota be known as Lane Lindquist Way.
This Resolution was adopted at a meeting of the Milbank City Council held on the 14th day of September 2020.

A motion was made and seconded to approve the bid submitted by J&J Earthworks for the Lake Farley Campground Improvements in the amount of $299,778.20. Wastewater – Councilman Karels reported the third quarter toxicity test passed. The 4-H lift station, air basin blower and vac trailer were repaired. A DENR inspection is scheduled for September 17, 2020.
Personnel – A motion was made and seconded to approve the Covid-19 Administrative Leave policy. Motion carried 6-0.

A motion was made and seconded to correct claim #7039, Milbank Area Chamber from $500 to $5,000 for the fireworks contribution. Motion carried 6-0. A motion was made and seconded to approve the claims list as amended, $2,285,781.68. Motion carried 6-0.
A motion was made and seconded to approve the second reading of Ordinance 830. Motion carried by roll call vote, 6-0.
A motion was made and seconded to approve the first reading of Ordinance 831 – 2020 Supplemental Budget. Motion carried by roll call vote, 6-0.

Airport – Foster reported Administrator Forman resolved the issues with the access gate card reader. Foster reported the PAPI lights were recalibrated. Helms & Associates are surveying the trees southeast of the runway and working with FAA to determine if any action is needed. Progress continues on the final avigation easement in the airport protective zone acquisition.
Unity Square – Councilman Johnson read the monthly report.
Fire – Councilman Hanson read the monthly report.
Planning & Zoning – A conditional use permit requested by Nicole Dunnihoo for a home-based day care at 1010 Adams Drive was approved. A conditional use permit and variance requested Dakota Country Feed & Seed for the installation of six 40-foot bin storage containers, was approved. A conditional use permit requested by J&J Land Sales for the construction of up to seven two-family dwelling units to be constructed on Lots 12-18, Valley View Addition was tabled. The Commission requested additional information.

Resolution to Approve Plat
Whereas, Craig D. DeBoer and Allison Jo DeBoer Owners of the thereafter described real property has submitted to the governing board a proposed plat of Lots 1 and 2 of Westside Car Wash Addition to the City of Milbank, Grant County South Dakota, and the Board of City Council of said City having examined the proposed plat and its appearing that all municipal taxes and special assessments, if any, upon said plat and survey have been executed according to law.
Now Therefore, be it Resolved that said plat and survey be and are hereby in all things accepted and approved.
