NOTICE IS HEREBY GIVEN that the City Council in and for the City of Big Stone City, South Dakota, on the fourth day of December 2023 at the hour of 5:50 p.m. at the city office building, will meet in regular session to conduct a hearing on whether to vacate street
PETITION TO VACATE STREET
TO: THE MAYOR AND CITY COUNCIL MEMBERS OF THE CITY OF BIG STONE CITY, SOUTH DAKOTA
The undersigned property owners respectfully represent:
1. The Petitioners are fee owners of the following described property situation in the City of Big Stone City, Grant County, South Dakota, to-wit:
PID #25.02.07.03 – Wade Van Dover and Cynthia Van Dover, as Trustees of the Wade and Cindy Van Dover Family Trust: Lots One (1), Two (2) and Three (3), Block Seven (7), Tenney and Martell’s Addition to the Village of Big Stone, Grant County, South Dakota
PID #25.02.07.06 – James R. Johnson and Brenda McMahon, as joint tenants: Lots Four (4), Five (5) and Six (6), Block Seven (7), Tenney and Martell’s Addition, City of Big Stone City, Grant County, South Dakota
PID #25.02.07.09 – Brenda K. McMahon and James R. Johnson, Jr., as joint tenants: Lots Seven (7), Eight (8) and Nine (9), Block Seven (7), Tenney and Martell’s Addition, City of Big Stone City, Grant County, South Dakota;
AND
Lot Ten (10), Block Seven (7), Tenney and Martell’s Addition to Big Stone City, Grant County, South Dakota;
EXCEPT The south 10 feet of Lot Ten (10), Block Seven (7), Tenney and Martell’s Addition, City of Big Stone City, Grant County, South Dakota
PID #25.02.07.12 – Samuel Hahn and Sheila Smith-Hahn, as joint tenants: The south 10 feet of Lot Ten (10), and all of Lots Eleven (11) and Twelve (12), Block Seven (7), Tenney and Martell’s Addition, City of Big Stone City, Grant County, South Dakota
2. The Petitioners request that the City vacate the right-of-way running between the above lots of the above legal descriptions shown on the drawing as Exhibit A.
3. That the above-described right-of-way is not necessary for traffic circulation. The vacation of the right of way would relieve the City of any responsiblity for maintenance or construction.
4. The City reserves an utility easement in the vacated right-of-way
Therefore, the petitioners respectfully request that a date for a hearing on this Petition be set, and at such hearing a Resolution be passed to vacate any interest the City may have in the above-described portion of said right-of-way.
Big Stone City, South Dakota should be vacated, reserving unto the City of Big Stone City its right to maintain utility easements for electric, gas, telephone and other public utilities along said property.
