ORDINANCE 842 BY AMENDING SECTION 17.03.01 OF THE
MILBANK MUNICIPAL CODE
Notice is hereby given pursuant to SDCL 11-4 that on the Eighth day of January 2024 at 6:00 p.m. in the City Offices in the City of Milbank, South Dakota, is the time and place when and where all persons interested therein may appear and be heard before the City Planning and Zoning Commission concerning the proposed annexation and zoning the real property described as Lot 21 Milbank Industrial Park Second Addition in SE1/4 & Lot 1 Redman’s Third Addition in SE1/4 excepting Lot 4 Berkner’s Addition and excepting Lot 1 & 2 Twin Valley Tire Addition all in Section 12, Township 120 North, Range 49 West of the 5th P.M., Grant County, South Dakota which upon platting will be known as the Plat of Milbank Industrial Park Third Addition Located in the City of Milbank and in the SE1/4 of Section 12, Township 120 North, Range 49 West of the 5th P.M., Grant County, South Dakota changes to the Zoning Ordinances of the City of Milbank. The Planning and Zoning Commission will submit to the City Council their recommendation as to whether or not the following ordinance should be passed by the City Council. If recommended for approval the City Council will then have the first reading of the proposed ordinance change at 7:00 p.m. on January 8, 2024. Petitioner(s) Grant County Development Corporation, Arvid & Janet Liebe the owner(s) of real property currently outside the city limits of the municipality of Milbank, South Dakota request the above legally described property with the following zoning designation of I1 (Light Industrial District).
The City Council will have the second reading February 12, 2024 at 7:00 p.m. of Ordinance 852 which establishes zoning designations as described above. The City Council may refuse or adopt Resolution 2-12-24 to annex the above described real property and Ordinance 852 with or without amendment. The proposed ordinance will be made available for public inspection at the Milbank City Office during regular business hours. Any persons wishing to present testimony may appear at said hearing or may file written comments with the Finance Officer, 1001 E 4th Ave, Suite 301 prior to said hearing. AN ORDINANCE ENTITLED, an ordinance to amend Section 17.03.01 of Ord. 842 the Zoning Ordinance of the City of Milbank.
Be it ordained by the City Council of the City of Milbank, South Dakota: that Section 17.03.01 adopted by Ordinance 852 as amended, of the Zoning Ordinance of the City of Milbank be amended to classify the following property: Lot 21 Milbank Industrial Park Second Addition in SE1/4 & Lot 1 Redman’s Third Addition in SE1/4 excepting Lot 4 Berkner’s Addition and excepting Lot 1 & 2 Twin Valley Tire Addition all in Section 12, Township 120 North, Range 49 West of the 5th P.M., Grant County, South Dakota which upon platting will be known as the Plat of Milbank Industrial Park Third Addition Located in the City of Milbank and in the SE1/4 of Section 12, Township 120 North, Range 49 West of the 5th P.M., Grant County, South Dakota to the City of Milbank to I1 (Light Industrial) from A (Agricultural District)
To address the Board of Adjustment, any property owner or their designee in the City of Milbank may notify and provide feedback and any materials to the Zoning Officer by noon on the Friday before the next scheduled meeting of the Board of Adjustment, this allows adequate follow-up time to address received feedback.
