NOTICE OF TITLE V AIR QUALITY OPERATING PERMIT
MODIFICATION APPPLICATION AND DRAFT PERMIT
MODIFICATION
The South Dakota Department of Agriculture and Natural Resources (DANR) has received and reviewed the application for a modification to a Title V air quality operating permit for the following applicant:
APPLICANT NAME: POET Biorefining – Big Stone, LLC
FACILITY LOCATION: Big Stone City, South Dakota
The Title V air quality operating permit will be modified to increase short term limits, install a tenth fermentation tank, and install a roller mill. The following processes and units are included in the permit modification:
1. Increase the annual undenatured ethanol production limit from 88 million gallons per year to 128 million gallons per year;
2. Unit #2 – Increase the maximum operating rate from 140 tons per hour to 150 tons per hour
3. Unit #4 – Increase the maximum beer feed rate from 34,026 gallons per hour to 45,000 gallons per hour;
4. Unit #4 – Increase the maximum mash rate from 165 tons per hour to 193 tons per hour;
5. Units #6, #7, and #29 – Increase the maximum operating rate from 30 tons per hour to 52 tons per hour;
6. Increase short term limits for Unit #6;
a. The nitrogen oxides short term limit from 14.0 pounds per hour to 20.0 pounds per hour;
b. The carbon monoxide short term limit from 15.0 pounds per hour to 20.0 pounds per hour;
7. Unit #4 – Increase the volatile organic compound short term limit from 10.1 pounds per hour to 20.0 pounds per hour;
8. Unit #4 – Increase the volatile organic compound short term limit from 15.2 pounds per hour to 20.0 pounds per hour;
9. Unit #26 – Correct the maximum beer feed rate from 74,490 gallons per hour to 45,000 gallons per hour;
10. Unit #26 – Increase the maximum mash rate from 165 tons per hour to 236 tons per hour;
11. Units #8 and #30 – Increase the maximum operating rate from 27 tons per hour to 52 tons per hour;
12. Increase the maximum grain processed from 899,360 tons of grain per 12-month rolling period to 1,308,029 tons of grain per 12-month rolling period;
13. Units #22, #23, #24, #25, #27, and #28 – Increase the maximum operating from 22 tons per hour to 25 tons per hour;
14. Increase the maximum Dried Distiller’s Grain and Soluble production from 296,789 tons per 12-month rolling period to 431,650 tons per 12-month rolling period;
15. Unit #16 – Change the description from “Ethanol Storage Tank” to “Denaturant (Natural Gasoline)”;
16. Units #17 and #18 – Change the description by removing “denatured”;
17. Unit #19 – Change the description from “(gasoline)” to “(natural gasoline)”; and
18. Units #4 and #26 – Allow alternative operating scenarios for the wet scrubbers.
A review of the modification indicates that POET Biorefining – Big Stone, LLC can still operate in compliance with South Dakota’s Air Pollution Control rules and the federal Clean Air Act. DANR, therefore, recommends that the Board of Minerals and Environment modify POET Biorefining – Big Stone, LLC’s existing Title V air quality operating permit with conditions to ensure compliance with South Dakota Codified Laws (SDCL) 34A1 and the federal Clean Air Act.
In accordance with the Administrative Rules of South Dakota (ARSD) 74:36:05:17, any person desiring to comment on DANR’s draft permit conditions related to the permit modification must submit written comments to the address by close of business on the thirtieth day of this public notice. Comments may be directed to the following mailing address: Samantha Olmstead; PMB 2020; Department of Agriculture and Natural Resources; 523 East Capitol; Pierre, South Dakota 57501. DANR will consider and address all comments submitted and issue a final permit decision pursuant to ARSD 74:36:05:18. DANR will notify the applicant and each person that submitted written comments or requested notice of DANR’s final permit decision, including notification of any changes to the permit based on the comments.
Any person desiring to contest the issuance of this permit modification and have a contested case hearing must file a petition, which complies with ARSD 74:09:01:01. This petition must be filed either by close of business on the thirtieth day of this public notice or, if that person submits comments on DANR’s draft permit pursuant to the paragraph above, within thirty days of receiving notice of DANR’s final permit decision. Upon receipt of a petition, DANR will schedule this matter for a contested case hearing before the Board of Minerals and Environment.
If no comments or objections are received by close of business on the thirtieth day of this public notice, the draft permit conditions related to the permit modification becomes the final permit decision and the proposed permit conditions will be submitted to EPA for review.
