The South Dakota Department of Agriculture and Natural Resources (DANR) has received an application from Otter Tail Power Company to renew a permit for operation of a Type I solid waste facility located in portions of Section 7, T121N, R46W, and portions of Sections 11 and 12, T121N, R47W; all in Grant County. The solid waste facility consists of an ash fill disposal area, restricted use facility, brine concentrator surface impoundments, and a lime sludge pond. The solid waste facility is located approximately one and a half miles west of Big Stone City. Total acreage of the site is approximately 148.4 acres. The permit renewal will be granted for a period of five years as provided for under South Dakota Codified Law (SDCL) 34A-6-1.16.
DANR has reviewed the application and information submitted, has reached a tentative decision, and recommends to the Board of Minerals and Environment (board) that the permit be renewed for the applicant to continue operation of the solid waste facility.
The recommendation for renewal of this permit is subject to the applicant's compliance with the Administrative Rules of South Dakota (ARSD) 74:27 (Solid Waste) and a total of 64 permit conditions and one variance. The permit conditions include general requirements (10 conditions), design and construction requirements (7 conditions), operating requirements (21 conditions), monitoring requirements (11 conditions), recordkeeping and reporting (5 conditions), closure requirements (8 conditions), postclosure requirements (1 condition) and financial assurance (1 condition). The one variance relates to how the applicant determines the tonnage of solid waste disposed at the solid waste facility. The permit conditions and variance are intended to ensure that the solid waste facility complies with the environmental laws of this state.  
In accordance with SDCL 34A-6-1.14, DANR's recommendation of approval will become the final decision on the permit application and this permit will be renewed 30 days after publication of this notice. A person adversely affected or having an interest adversely affected by the DANR's recommendation of approval may petition the board for a contested case hearing.  The petition must comply with the requirements of ARSD 74:09:01:01.  If a petition for such a hearing is not filed within 30 days of this publication date, a permit renewal will be formally and finally granted at that time.
