     December 30, 2021
The Grant County Commission met at 8 AM with Commissioners Buttke, Mach, Street and Tostenson present. Commissioner Stengel joined the meeting by telephone. Chairman Tostenson called the meeting to order with a quorum present and asked for a motion to approve the minutes. Motion by Mach and seconded by Buttke to approve the minutes of the December 21, 2021, meeting. Motion carried 5-0. Minutes filed. Motion by Buttke and seconded by Street to approve the agenda. Motion carried 5-0.
Members of the public present were Kevin Souza and District 4 Senator John Wiik. Staff present were States Attorney Schwandt, Drainage Officer Berkner and Deputy Auditor Folk.
The Chairman called for public comment. Kevin Souza spoke on the golf course being a great asset to the community and the improvements being planned for the course.  He asked the Commission to consider a donation to the golf course. The Commission thanked him for speaking on behalf of the course. Chairman Tostenson expressed concern with approving a donation to a private entity. Commissioner Mach suggested the Commission consider assisting with golf course road repair.
Commissioner Mach asked P & Z Officer Berkner if 100% of the residents within one mile of a CAFO need to sign off on an expansion. P & Z Officer Berkner answered yes. Chairman Tostenson closed the public comment. 
Drainage: Chairman Tostenson adjourned the Board of Commissioners and convened the Commission acting as the Drainage Board. Commissioner Street made a motion to reconsider a motion made at the December 21 meeting that set the violation for permit DR2021-38 at $500 per day for four days to an amount of $200 per day for four days. Chairman Tostenson called for a second. The motion to reconsider failed due to lack of a second. The Drainage Board discussed the penalty sections of the ordinance and sending a letter to area tilers to give them a copy of Section 320 which states it is a violation of the ordinance to commence tile work without a permit.  
This concluded the business for the Drainage Board. Chairman Tostenson adjourned the Drainage Board and reconvened the Board of Commissioners.
Legislative Session: District 4 Senator John Wiik spoke on the 2022 redistricting for the legislative districts which will take effect after the 2022 General Election. Grant County remains in legislative district 4. He also spoke on Amendment C, affordable health care, mental illness, Covid, small structure inventory including funding, water management and commercial vehicle inspection. 
2021 Year End: The Commission reviewed the year end financials. The following motions were made.

Public Defender Contract: Motion by Street and seconded by Stengel to approve the Public Defender contract with Bratland Law for $4,211.65 per month for 2022. Motion carried 5-0.
  Personnel Policy: Motion by Mach and seconded by Buttke to adopt these amendments to the Personnel Policy. Motion carried 5-0. 
1. Add Juneteenth Day to the list of recognized holidays.
2. Add a statement in Section Leave of Absence, A. General Policy: Any leave of absence that is taken by an employee will be recorded to coincide with the employee’s scheduled hours for the days of absence.  
3. Any employee with benefits who works less than 40 hours per week will have the holiday prorated base on hours worked. 
Commissioner Stengel excused himself from the meeting at 10:07 AM.
2022 Salary Resolution:  Motion by Street and seconded by Buttke to approve the 2022 salary resolution as presented. Motion carried 4-0. Resolution adopted.

January 4, 2022
The Grant County Commission met at 8AM with Commissioners Buttke, Mach, Stengel, Street and Tostenson. Chairman Tostenson called the meeting to order. Motion by Mach and seconded by Stengel to approve the minutes of the December 30, 2021, meeting. Motion carried 5-0. Minutes filed. Motion by Buttke and seconded by Stengel to approve the agenda. Motion carried 5-0.
Chairman Tostenson addressed the Commission. He thanked them for the opportunity to serve as Chairman. He encouraged them to be a proactive Commission. He stated he appreciated the debate done at the table as it was done respectfully, and the Commission acted as one after the vote was taken. He also commented on administering the drainage ordinance, addressing salaries, benefits, buildings, infrastructure as these are continuing issues for the Commission. He again thanked the Commission for allowing his comments and for their support as he served as Chairman. 
There being no final business to consider for 2021, Chairman Tostenson adjourned the meeting sine die and Auditor Layher assumed the chair.  Nominations for Chairman were called. Commissioner Mach nominated Bill Tostenson. Commissioner Buttke nominated Commissioner Stengel. Motion by Mach and seconded by Stengel to close nominations and to cast a ballot for the Chairman position. The ballots cast were 3 to 2 with Commissioner Stengel being seated as Chairman for 2022.
Nominations for Vice-Chairman were called. Motion by Tostenson and seconded by Buttke to nominate Mach for Vice-Chairman and for nominations to cease and to cast an unanimous ballot for Mach. Motion carried 5-0. 
Members of the public present were Dan Scoblic and Jim DeVaal. Staff member present was Steve Berkner.
The Chairman called for public comment. Dan Scoblic commented on the impressive bridge structure installed by the DeVaal residence. Discussion included the pony truss bridge location.
Highway: Motion by Mach and seconded by Tostenson to authorize the Chairman to sign the letter to be sent to the Motor Carrier Division requesting assistance with enforcing the weight restrictions during the spring thaw. Motion carried 5-0. 
The next item for consideration was the spring weight limit restriction. Motion by Street and seconded by Buttke to set the weight limit of seven tons per axle with the following resolution with the list of roads exempt from the weight limit restrictions. Motion carried 5-0. Resolution adopted.

GRANT COUNTY WEIGHT / SPEED LIMIT ENFORCEMENT RESOLUTION
WHEREAS, seasonal climatic changes can be detrimental to our highways, and 
WHEREAS, The Grant County Board of County Commissioners desires to protect existing Grant County Highways, ultimately saving tax dollars, and
WHEREAS, the Grant County Board of County Commissioners desires the enforcement of weight limitations on Grant County roads as set forth and posted by the Grant County Highway Superintendent.
NOW THEREFORE BE IT RESOLVED:
WHEREAS the limits on Grant County roadways shall be set at a maximum load limit of seven tons per axle on all asphalt surface roads during the spring thaw period from March 1, 2022 to April 30, 2022, inclusive, when weight limit signs are in place. The South Dakota Highway Patrol be, and hereby is authorized and requested to enforce the weight limitations on Grant County roads; and
NOW THEREFORE BE IT RESOLVED:

Auditor Layher reported both members had agreed to serve another term. Motion by Tostenson and seconded by Buttke to appoint Nancy Johnson and John Seffrood to a 3-year term ending December 31, 2024. Insurance: Motion by Mach and seconded by Tostenson to approve SDPAA as the 2022 liability and property insurance carrier. Motion carried 5-0. Motion by Mach and seconded by Tostenson to approve the SDML Worker’s Compensation Fund as the workers comp carrier for 2022. Motion carried 5-0.

Redistricting: The 9:00 AM public hearing was held for the second reading of Ordinance 2022-01.

AN ORDINANCE REPEALING
EXISTING GRANT COUNTY
COMMISSIONER VOTING
DISTRICTS AND ESTABLISHING NEW VOTER DISTRICTS BASED UPON 2020 CENSUS, PER SDCL
7-8-10 AND 7-8-12, BY DIVIDING GRANT COUNTY INTO FIVE (5) COUNTY COMMISSIONER
DISTRICTS AND ESTABLISHING THE BOUNDARIES THEREOF.
Chairman Stengel opened the meeting to public comment on Ordinance 2022-01. No members of the public were present to offer comment. Chairman Stengel closed the public portion of the meeting and asked if the Commission had any other questions, and none were indicated. Chairman Stengel called for a motion. Motion by Street and seconded by Mach to approve the second reading and to adopt Ordinance 2022-01 for the redistricting of the Commission districts based on the 2020 census. Motion carried with Buttke, Mach, Stengel, Street and Tostenson voting aye. Nay: none. The ordinance is on file in the auditor’s office.

Auditor Layher was present. Chairman Stengel declared the meeting open to the public at 9:45 AM. Motion by Mach and seconded by Tostenson to authorize the Auditor to hire a full-time deputy as part of the succession plan to prepare for the transfer of duties from the auditor to commission assistant/ county administrator. Motion carried 5-0. Motion by Tostenson and seconded by Mach to move the Commission chamber to the Community Room in the Courthouse basement for space reasons. Motion carried 5-0.
