NOTICE OF INTENT TO

CONSTRUCT AN ANIMAL

FEEDING OPERATION

Notice is hereby given that the SD Department of Agriculture and Natural Resources (DANR) has received an application for state permit coverage under the 2017 General Water Pollution Control Permit for Concentrated Animal Feeding Operations (2017 general permit) for an expanding animal feeding operation from:

The expanding dairy feeding operation is located in the South 1/2 of the Southeast 1/4 of Section 32, Township 119 North, Range 48 West in Grant County, approximately one mile north and two miles west of Albee. The existing operation is currently permitted under the 2003 general permit for 5,000-head of mature dairy cattle.

The proposed expansion is for an additional 2,150-head of mature dairy cattle for a proposed maximum of 7,150-head of mature dairy cattle. No modifications to the existing manure management system are proposed with this expansion. The existing system consists of one freestall barn with a vacuum wagon system, a building with a milk parlor, holding area, office and two concrete collection pits, a feed storage area, a solids separator building with a concrete pit, piping, a concrete solids storage area, three holding ponds, and 0.34 acres of drainage area. With the expansion, the concrete solids storage area will have at least 365 days of solids storage capacity and the holding ponds will have at least 365 days of liquid storage capacity. The manure will be land applied to fields located in portions of the following sections in Grant County:

Sections 3, 4, 5, 6, 7, 8, 17, 18, 19, and 20 in Township 118 North, Range 48 West;

Sections 1, 2, 13, and 24 in Township 118 North, Range 49 West;

Sections 16, 17, 18, 19, 20, 21, 22, 23, 26, 28, 29, 30, 31, 32, 33, and 34 in Township 119 North, Range 48 West; and

Sections 13, 24, 25, 26, and 36 in Township 119 North, Range 49 West.

Any person desiring to comment on whether the application meets the general permit requirements must submit written comments within thirty (30) days of the publication of this notice. Commenters shall provide their name and address, a statement of the action they wish the department to take, and the facts supporting their position. Capitol Ave., Pierre, SD 57501-3182. DANR will consider and address all comments submitted. A copy of this notice and online commenting are available at https://danr.sd.gov/public. A final permit decision will be made after 30 days of this publication notice.
