Call to Order - The City Council met in regular session on April 10, 2023 at 7:00 p.m. in the Visitor Center, 1001 East Fourth Avenue, Mayor Raffety presiding.
Roll Call - Mayor Raffety. Councilmembers: Roger Briggs, Mike Hanson, Mindy Rogers, Craig Weinberg, John Weyh. Absent: Josh Karels.
Staff Present: Attorney Mark Reedstrom, Darin Thiele, Dick Poppen, Scott Meyer, Donald Settje, Dan Keyes, Cynthia Schumacher, John Forman, Corey Hooth, Ron Krause, and Kevin Schuelke.
Public Present: Holli Seehafer, Nathan Watson, Kathy Ward.
Public Comments – None.
Minutes – A motion was made and seconded to approve the minutes of the March 13, and March 20, 2023, meetings. Motion carried 5-0.
Department Reports
Water – The Twin Brooks well #2 was shut down due to flooding. Well #3 is being utilized. The City is averaging 31% spring water.
The Council reviewed water rate increase options. A motion was made and seconded to move forward with a 60% base rate, 40% usage rate increase. Administrator Forman was directed to work with Banner Associates to produce a mailer to residents showing this anticipated increase.
Motion carried 5-0.
Streets – Thanks to Bryan Lambrechts for helping with snow removal. The asphalt trailer is ready for pothole patching to begin.
Bituminous Paving Inc. was the only bid received for street materials. A motion was made and seconded to approve BPI’s bids as follows: BS 1-Hot mix, picked up-$81.00/ton. BS 2-machine laid asphalt - $86.00/ton. BS 3 – aggregate base course-no bids. BS 4 – Asphalt milling, 2” - $2.90/sq yd. Motion carried 5-0.
Rubble Site – No report.
Lake Farley – No report.
Park – The skate park proposal was reviewed. A motion was made and seconded to call for bids and confirm the skate park location to be behind the visitor center, near the pickle ball courts. The estimated project cost is $62,431.00. Motion carried 4-1. Councilmember Weinberg stated he was not in favor of the location.
A public hearing was held for a Special Malt Beverage & SD Wine License application requested by the Milbank Area Chamber for the Cinco de Mayo event. The event will be held at Lake Farley Park on May 6, 2023, 2:00 to 9:00 p.m. No objections were heard. A motion was made and seconded to approve the license. Motion carried 5-0.
A motion was made and seconded to approve the Special Event Permit for It Only Takes a Spark Cancer Walk at Lake Farley Park on June 9-10, 2023. The event will include the cancer walk, community picnic, inflatables, and fireworks. Motion carried 5-0.
A motion was made and seconded to approve the Special Event Permit for the Milbank Area Chamber Farley Fest at Lake Farley Park on July 27-29, 2023. The event will include vendors, food trucks, inflatables, live music, car show and parade on Main Street on July 29, 2023. Motion carried 5-0.
A public hearing was held for a Special Malt Beverage & SD Wine License application requested by the Milbank Area Chamber for the Farley Fest event. A motion was made and seconded to approve the application for Lake Farley Park on July 28, 4:00 – 11:30 p.m. and July 29, 2023, 10:00 a.m. to midnight. No objections were heard. A motion was made and seconded to approve the license. Motion carried 5-0.
Unity Health & Fitness – An agreement is being drafted between the City and the Milbank Ball Diamond Association, to provide a framework for the use and management of the Lake Farley baseball facility by MBDA, the City and third parties.
A draft of Unity’s 24-7 access revised restrictions has been submitted to Attorney Reedstrom and the City’s insurance carrier for review.
Fire – A weather spotter class will be held on April 27th. A Volunteer Fire Assistance grant was awarded for PPE including SCBA voice amps and tech rescue gear.
Airport – No report.
Finance – A supplemental budget will be forthcoming due to projects budgeted and not completed in 2022.
A motion was made and seconded to approve the March treasurer's report. Motion carried 5-0.

Planning & Zoning – A motion was made and seconded to approve the second reading of Ordinance 846, changes to Chapter 16. Motion carried by roll call vote 5-0.
A motion was made and seconded to approve the first reading of Ordinance 847 – Rezoning of Block 2, Hunts Addition from an A1, agricultural district to an R2, general residential district. Motion carried by roll call vote 5-0.
A motion was made and seconded to approve Resolution 11-14-22-Revised. Attorney Reedstrom explained there were minor changes required to be compliant with the land surveyors and the courthouse.

RESOLUTION TO VACATE
PUBLIC PROPERTY
WHEREAS, the City Council, City of Milbank, Grant County, South Dakota, has authorized the City Administrator to give notice by publication pursuant to SDCL 9-45-08, of intent to vacate a public street right-of-way in the City of Milbank and appointed the Milbank Planning and Zoning Commission to conduct a public hearing and investigation. Notice of said public hearing was given in the Grant County Review on July 19, 2017, and July 26, 2017.
WHEREAS, the Planning and Zoning Commission did investigate and held a public hearing on August 7, 2017 hearing the testimony and evidence of the attending public. A motion was made and approved during the Planning and Zoning meeting to recommend the vacation of the public street right-of-way described as an unnamed and undeveloped right-of-way in Block 1, Highland Heights Addition, City of Milbank, Grant County, South Dakota.
THEREFORE, BE IT RESOLVED that the City Council of the City of Milbank does hereby grant the vacation of the above-described street right-of-way, see Exhibit A.
This right-of-way vacate is not complete until the described property is approved by both the City of Milbank Planning & Zoning Commission and the Milbank City Council and filed at the Grant County Register of Deeds office.
This Resolution is adopted this 14th day of November 2022.

GCDC & Chamber – GCDC executive board is working on term sheets and conditions for housing developers. The chamber hired a new program and event coordinator, Karla Hernandez.
Personnel - No report.
Wastewater – A new controller was ordered for the clarifier. Two new valves were ordered for chlorination.
Police – All radios in the squad vehicles have been updated. Programming along with updates to portables have been done to become compliant for upcoming September P-25 statewide radio update.
A motion was made and seconded to approve hiring William Newstrand, part-time police officer, $22.40, 4/10/23.
Executive Session -A motion was made and seconded to go into Executive Session pursuant to 1-25-2(1). Motion carried 5-0. Mayor Raffety called the council out of executive session.
A motion was made and seconded to approve Administrator Forman to advertise for a position in the water department, wastewater department and park department. Motion carried 5-0.
Adjourn - Next Regular meeting is May 8, 2023, at 7:00 pm. A motion was made and seconded to adjourn. Motion carried 5-0.
