A Judgment and Decree of Foreclosure, having been filed on December 12, 2023, by the Circuit Court for the THIRD Judicial Circuit, Grant County, in the action entitled CitiMortgage, Inc. v. Ryan L. Hilbrands, et al, Civ. 25CIV23-000067, which Judgment and Decree of foreclosure in part directed a foreclosure sale of the following described real property in Grant County, South Dakota:
THE EAST 65 FEET OF LOT 21 AND THE EAST 65 FEET OF THE NORTH 40 FEET OF LOT 20, BLOCK 46, CITY OF MILBANK, GRANT COUNTY, SOUTH DAKOTA
(aka 110 W 5TH AVE., MILBANK, SD 57252-2415)
Together with all improvements, easements, rights and appurtenances on or accruing to such property;
NOTICE IS HEREBY GIVEN that for the purpose of realizing the sum of $94,460.38 as of November 30, 2023, plus interest accruing thereafter on said amount at the rate of 4.625% per year together with the costs and expenses of sale, will be sold subject to redemption as provided by law as one parcel of land at public auction subject to the lien for unpaid real estate taxes and assessments of Grant County, South Dakota, and easements and restrictions of record, to the highest bidder for cash, by the Sheriff of Grant County, at the Grant County Court House (front steps) in Milbank, South Dakota at the hour of 10:00 a.m. (CT) on January 26, 2024. Such property is that described in a security instrument dated December 22, 2010, recorded January 20, 2011 in Doc. No.:221272 Book 382 Page 36; which mortgage was assigned to CitiMortgage, Inc. by Assignment of Mortgage recorded June 05, 2014, in Doc. No.:227815, executed by Ryan L. Hilbrands and Kelly L. Hilbrands, Joint Tenants.
If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The purchaser shall have no further recourse against the Mortgagor or the Mortgagee’s attorney.
